Terms of Use

Last updated:

Please read these Terms of Use (these “Terms”) carefully. DreamGuard and its website, developer dashboard, and inference API (the “Service”) are operated by Vanna Laboratories, Inc. (“Company”, “we”, “us”, “our”). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. The service

DreamGuard provides developer tools and API access for inference using open models, including modified or abliterated variants, with confidential computing features. Available models, endpoints, and features may change. The underlying output is generated by the model you select.

The current dashboard is a preview using mock data. Its sign-in options do not authenticate a live account, and its API keys, request logs, balances, and settings are demonstrations. Preview mutations do not create live credentials, process payments, or enforce request policies.

We do not control or warrant the accuracy, reliability, or safety of model responses. Confidential computing protects aspects of processing; it does not guarantee that a model’s output is correct or safe.

2. Requests and data handling

Your prompts, messages, parameters, and other submitted material are “Input”; responses returned by a model are “Output”. Our Privacy Policy explains how we handle information associated with the Service.

Live confidential inference is designed to process request content inside trusted execution environments without retaining prompts or responses in request logs. Verify the security requirements and capabilities of your chosen endpoint and client before submitting sensitive information. Preview privacy settings do not establish that these protections are active.

You are responsible for the information you submit and for any copies of Input or Output stored by your application, client, or integrations. Do not rely on DreamGuard as a backup or archive of your content.

3. Your account

You must be at least 13 years old (or the minimum age in your jurisdiction) to use the Service. You are responsible for activity under your account, for the applications you connect, and for keeping credentials and API keys safe. If you use DreamGuard on behalf of an organization, you represent that you have authority to accept these Terms for that organization.

4. Acceptable use

You must comply with applicable law and the licenses and usage policies applicable to your selected model. A model’s reduced refusal behavior or lack of an automated filter does not permit prohibited use. You may not use DreamGuard for:

  • Illegal, discriminatory, or harmful activity, including hateful, harassing, or threatening content; terrorism, violent extremism, or animal abuse; promoting suicide, self-harm, or disordered eating; or fraudulent or deceptive uses of Output.
  • Violating others’ privacy, intellectual property, or other rights; creating spam, malware, or computer viruses; or gaining access to computer systems without authorization.
  • Sexually explicit or obscene content.
  • Endangering children, including creating, uploading, or distributing child sexual abuse material, including AI-generated material; facilitating the exploitation or abuse of minors; or sexualizing minors in any context.
  • Activity with a high risk of physical or economic harm, including designing weapons, explosives, or other dangerous materials, or promoting predatory financial practices, multi-level marketing, gambling, or sports betting.
  • Creating non-consensual intimate imagery, deceptive deepfakes, or photorealistic images, video, or audio of real people without their consent.
  • Providing regulated legal, financial, or medical advice or services; political campaigning or lobbying; determining eligibility for credit, education, housing, or employment; governmental decision-making such as law enforcement or immigration decisions; or facilitating academic dishonesty.
  • Interfering with DreamGuard or its infrastructure, including circumventing rate limits, safeguards, access controls, or other restrictions, or accessing models or data you are not authorized to use.

We may suspend or terminate accounts that violate these Terms or put the Service or other users at risk. Illegal content may be reported to the relevant authorities where required by law.

5. Safety features and model limitations

Safety mechanisms may block requests or outputs, but automated screening is imperfect and may differ by model or endpoint. Some open or abliterated models may have reduced or no model-level moderation. You remain responsible for every request you submit and for your use of the results.

The preview does not enforce live moderation or suspension policies. We do not promise that every live request will be screened or that prohibited content will always be detected. If you believe access was suspended in error, contact legal@opengradient.ai for review.

6. Your applications and generated code

You are responsible for supervising your integrations, securing your applications, and reviewing Output before relying on it or making it available to others. Code generated by a model may be inaccurate, insecure, or behave in unintended ways. Review and test it before execution.

7. Reporting infringing or illegal content

If you believe your intellectual property rights have been infringed, or that content violates these Terms or the law, email legal@opengradient.ai with the details of your claim. Do not include API keys or unnecessary personal information.

Users in the EEA may contact the same address to access our internal complaints handling process where applicable under the EU Digital Services Act.

8. Indemnification

You agree to indemnify and hold harmless Vanna Laboratories, Inc., its affiliates, employees, and other agents from and against claims, losses, and expenses (including attorneys’ fees) arising from or relating to your use of DreamGuard, including your subsequent use of Output, your breach of these Terms, or your violation of third-party rights or applicable law.

9. Content

You retain all rights to the Input you submit and the Output returned to you, subject to applicable law and the rights, licenses, and terms of the underlying model providers. You are responsible for ensuring you have the rights to submit your Input and for how you use any Output.

You grant us only the limited rights necessary to process your request and provide the Service. Output may not be unique; other users may receive similar results. We do not warrant that Output is original or non-infringing.

10. Billing and credits

Live features may require credits or a paid plan. Prices, usage rates, any applicable taxes, and any recurring charges are shown before purchase. Credits are consumed as you use the Service and may expire as disclosed at purchase. Except where required by law, payments are non-refundable. We may change prices for future purchases on reasonable notice.

Auto-recharge or recurring billing applies only if enabled through a live payment flow with the relevant terms disclosed. Preview balances, payment methods, and billing controls do not authorize charges.

11. Third-party models and providers

DreamGuard depends on model developers and infrastructure providers. Your use of a selected model is also governed by its applicable license and provider terms and policies. We are not responsible for third-party availability, content, or changes to their offerings. Model names do not imply affiliation with or endorsement by their developers.

12. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of model output.

AI models can produce inaccurate, biased, harmful, or misleading information, and generated code may contain errors or behave unexpectedly. You should not rely on Output for medical, legal, financial, or other professional advice. We do not guarantee uninterrupted availability or that the Service will meet every security or compliance requirement of your application.

13. Limitation of liability

To the maximum extent permitted by law, Vanna Laboratories, Inc. and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, or damage to your device, files, or systems, arising out of or related to your use of the Service, including your use of generated code.

Our aggregate liability for claims arising out of or related to the Service will not exceed the greater of (a) amounts you paid us in the twelve months preceding the event giving rise to the claim and (b) one hundred U.S. dollars. These limits apply only to the extent permitted by applicable law and do not limit rights that cannot lawfully be excluded.

14. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, if we are required to do so by law, or if we discontinue the Service. On termination, the sections of these Terms that by their nature should survive will survive.

15. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you in the app or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
